These Terms of Use (“Terms”) govern your use of the business valuation calculator at mybusiness-value.com (the “Tool”), operated by Trustmark Mergers & Acquisitions(“Trustmark”). By using the Tool, you agree to these Terms. If you do not agree, please do not use the Tool.

1. What the Tool Is — and Is Not

The Tool provides an automated, indicative estimate of business value based on the information you enter and industry-standard rules of thumb. It is not a formal business appraisal, a certified valuation, or an offer, and it should not be used to obtain credit or for any other commercial purpose. Your actual sale price may vary significantly based on market conditions, buyer motivation, quality of earnings, due diligence, and other factors.

2. Not Professional Advice

The Tool and its output do not constitute financial, investment, tax, accounting, or legal advice, and do not create an advisory or fiduciary relationship. You should consult qualified professionals before making decisions about your business.

3. Your Information

You are responsible for the accuracy of the information you enter. Estimates are only as reliable as the inputs provided. Our handling of your information is described in our Privacy Policy.

4. No Warranty

The Tool is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including accuracy, completeness, merchantability, or fitness for a particular purpose. Trustmark does not represent or endorse the accuracy or reliability of any estimate, opinion, or information provided through the Tool.

5. Limitation of Liability

To the fullest extent permitted by law, Trustmark will not be liable for any indirect, incidental, consequential, or special damages, or for any decisions made in reliance on the Tool or its output.

6. Intellectual Property

The Tool, its content, and its branding are owned by Trustmark and are protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works without our permission.

7. Regulatory Notice

Trustmark Mergers & Acquisitions is not registered as a broker-dealer with the Securities and Exchange Commission (“SEC”) in reliance upon the “M&A brokers” exemption added as new Subsection 15(b)(13) to the Securities Exchange Act of 1934, as amended, effective March 29, 2023, and comparable state-level exemptive relief.

8. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules.

9. Changes

We may update these Terms from time to time. Continued use of the Tool after changes take effect constitutes acceptance of the revised Terms.
